AFC-M23 Forms Commission to Restore Justice in Liberated Territory

AFC/M23 has officially established a commission tasked with launching and supervising the revival of the justice system in territories under its control.

The decision is contained in Decision No. 008/COORDO/AFC-M23/2025 issued by the Alliance Council.

According to the AFC, this move follows more than six months of relative security and social stability in liberated areas, creating the right conditions to restore judicial authority.

The Council says the initiative is a strategic step to uphold the rule of law, fight impunity, and address communities’ needs for justice and legal protection, while reinforcing peace and reconciliation efforts already underway.

The decision cites previous resolutions from the AFC Council meeting on 15 December 2023, and conclusions from the Alliance’s founding acts consolidation workshop held in Bunagana on 20 December 2023.

It also denounces the destruction and looting of court buildings, the criminal burning of Munzenze central prison, and the intimidation of magistrates and court staff by Kinshasa government forces, which the AFC accuses of seeking to paralyze the justice system in the liberated zones.

The new commission has been mandated to oversee the re-establishment of courts and tribunals in these territories.

It will be led by about two dozens of legal experts with Mr. Kimbulungu Délion as President (Deputy Permanent Secretary), Me Mugisa Tibasima Emmanuel as Vice President, Me Ndayambaje Damien as the Rapporteur and Me Mutela wa Mutela Elie, the Deputy Rapporteur.

Other members include Me Sukay Mombe Israël, Me Shaka Jean-Paul, Me Bwino Nzobe Akilimali Jean-Paul, Me Tikailei Baundjwa Doudou, Me Hassan Hussein Bihando, Mr. Kamanga Bofenda Timothée, Mr. Mucyo Pacifique, Mr. Ndaisaba Ngabo Célestin, Mr. Kilima Mangowa Jean de Dieu, Mr. Kakule Simbi Josaphat, Mr. Paluku Kavunga Magloire, Me Midagu Mutiya Déogratias, Me Tshisola Kwasa Mukwenu Yannick, Dr. Kimanuka Lusang Alex, Mr. Habamungu Birego Christian, Mme Muhamiriza Noëlla, and Mme Murara Judith.

The AFC says the commission’s work is urgent and necessary to rebuild the justice system, restore legal order, and provide reliable judicial services to populations in liberated areas of the Democratic Republic of Congo.
